  PATENTS  

A patent may be granted for any invention, in all fields of technology, provided that it is new, involves an inventive step and is susceptible of industrial application.

As an patentable invention is considered any technical solution to a technical problem. This means that whatever is theoretical or intangible is excluded from patentability. One of the most treated questions of patentability is whether software can be protected by a patent. The European and Greek legislation, in principle, excludes software from patentability. However, practice has shown that there are ways to protect computer software with a patent.

The office udertakes the filing of patent applications in Greece and the EU (European Patent), the translation and filling of claims at the Greek Industrial Property Organization for European Patents or Patents filed in WIPO with PCT System, as well as protection from infringements and drafting exploitation contracts.

As an Industrial Design (2 dimensions) or Model (3 dimensions) can be protected the whole appearance or part of a product resulting from features (outline, color, shape, etc.). The corresponding right in American and Chinese legislation is the design patent.

  ENSURING SALES - RECOVERY IN ARREARS  

Ensuring, where possible, the sale can be made simply by indicating special conditions on the delivery note or invoice (which must be signed by the buyer) or by separate agreement, if the products or services to be sold are of great value.

In any case, if the sale is made without taking care to ensure it earlier, the office handles extra-judicial and judicial proceedings for recovery in arrears.

  PROCEDURES BEFORE INDEPENDENT ADMINISTRATIVE AUTHORITIES  

The independent administrative authorities is an international trend that has affected Greece as well. They are usually private entities, who, however, exercise public power. They have supervisory, regulatory and often quasi-judicial powers, imposing penalties and fines.

Companies may have the obligation to notify to an independent administrative authority their operations or cooperations with other companies. Such operations may be subject to a simple notification or thw granting of permission after the notification.

The office provides advice on whether it is necessary or not to notify an operation to one or more independent authorities and handles procedures before independent administrative authorities (Hellenic Data Protection Authority, National Telecommunications and Post Commission, National Organization for Medicines, Hellenic Competition Commission, Consumer Ombudsman, Industrial Property Organization etc.)
